Please read these Terms of Use (“Terms”) carefully before using YourPapakura.org (the “Site”).
By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who we are
The Site is operated by Papakura Community Network (PCN), a community network based in Papakura, Auckland, New Zealand (“we”, “us”, “our”). We are not a company, council, emergency service or registered charity.
The Site exists to share local information about organisations, events and key contacts in Papakura. It does not provide formal professional, legal, medical or financial advice.
At this stage, only PCN members and authorised volunteers can log in and publish or edit content on the Site. General visitors can browse the Site and contact us, but they do not have publishing accounts.
2. Using the Site
By accessing or using the Site, you agree to:
- use the Site only for lawful purposes
- follow these Terms and any other guidelines we publish on the Site
- respect local organisations, groups and individuals mentioned on the Site.
You must not:
- use the Site in any way that is unlawful, defamatory, abusive, threatening, misleading, discriminatory or otherwise harmful
- harass or abuse other people
- attempt to gain unauthorised access to the Site, user accounts or systems
- interfere with the normal operation of the Site (for example, by trying to overload it or bypass security measures)
- use the Site to send spam or other unwanted communications.
We may suspend or block your access to the Site, or take other action we reasonably consider necessary, if we believe you are misusing the Site or breaching these Terms.
3. Information you give us to publish
You may choose to send us information (for example, by email or form) about your organisation, group or event for publication on the Site.
By sending us information to publish, you:
- Promise that:
- the information you provide is accurate to the best of your knowledge
- you have the necessary rights and permissions to share it (for example, permission to use your organisation’s logo or photos)
- your information does not infringe anyone else’s rights or break any laws.
- Grant us a licence:
- You grant Papakura Community Network a non‑exclusive, royalty‑free licence to use, reproduce, modify (for formatting and editing), publish and display your content on the Site and in related materials that promote the Site or PCN’s work.
- You can ask us to update or remove your content at any time, and we will do our best to act reasonably and promptly. However, some copies (for example in backups or screenshots) may continue to exist for a period of time.
- Remain responsible for your information:
- You are responsible for the accuracy and legality of the information you provide. We do not independently verify all details before publishing.
We reserve the right to decide what is published on the Site. We may edit, decline or remove content at any time, especially if we consider it inaccurate, out of date or inappropriate.
4. Directory listings and events
The Site’s directory and events calendar are provided for general community information only.
- Listings are created and updated by PCN based on information from local organisations, public sources, and our own knowledge of the community.
- We cannot guarantee that any listing or event is current, complete or accurate.
- Inclusion of an organisation or event does not mean we endorse it, and omission does not imply disapproval.
Before relying on any listing or event (for example, turning up to an event or making a donation), please check details directly with the organiser.
The Key Contacts / “Report a Problem” information is also provided for convenience only. It does not replace emergency services or official council communications. In an emergency, call 111 or contact the appropriate authority directly.
5. Accounts and passwords (PCN members)
Currently, only PCN members and authorised volunteers have user accounts for the Site.
If you have an account, you must:
- provide accurate information and keep it up to date
- keep your password secure and not share it with others
- tell us as soon as possible if you suspect unauthorised use of your account.
You are responsible for activity that happens under your account until you tell us your account may have been compromised.
We may suspend or close accounts that are inactive for long periods, or that we reasonably suspect are being misused.
6. Privacy
Our Privacy Policy explains how we collect, use and protect personal information on the Site. By using the Site, you agree that we can handle your information in line with that policy.
If these Terms conflict with the Privacy Policy on any privacy‑related point, the Privacy Policy will usually prevail.
7. Intellectual property
Unless otherwise stated:
- The overall design and layout of the Site, and content we create (such as text, graphics and structure), are owned by Papakura Community Network or used with permission.
- Logos and content for individual organisations and events remain the property of their respective owners.
You may:
- view the Site and print or save reasonable copies of pages for your personal or community use
- share links to the Site and to public listings/events.
You must not, without our permission or the permission of the relevant owner:
- copy large parts of the Site or directory to create your own database or directory
- use content from the Site for commercial purposes
- remove any copyright or attribution notices.
If you believe content on the Site infringes your copyright or other rights, please contact us with:
- your name and contact details
- a description of the content and where it appears on the Site
- an explanation of why you believe your rights are infringed.
We will review your request and respond as soon as we reasonably can.
8. Third‑party services and links
The Site may include:
- links to external websites, social media pages and map services
- embedded content from other platforms (for example, videos or maps)
- tools provided by third parties, such as translation (GTranslate) or analytics (Google Analytics, Jetpack).
These third parties have their own terms and privacy policies. We do not control them and are not responsible for their content, availability or practices.
Using those services is at your own risk.
9. Disclaimers
To the fullest extent permitted by New Zealand law:
- The Site is provided “as is” and “as available”.
- We do not guarantee that the Site will be uninterrupted, secure, error‑free, up to date, or free from viruses or other harmful components.
- Information on the Site is general community information only. It is not professional advice and should not be relied on as such.
- We do not guarantee the accuracy, completeness or reliability of any content, including directory entries, events or key contacts.
Nothing in these Terms is intended to limit your rights that cannot lawfully be limited under New Zealand law.
10. Limitation of liability
To the extent permitted by New Zealand law, we (and our volunteers, coordinators and partners) are not liable for any loss, damage, cost or expense arising from or in connection with:
- your use of, or inability to use, the Site
- reliance on any information on the Site
- actions you take based on listings, events or key contacts
- any third‑party websites or services linked to from the Site.
This includes (without limitation) loss of profits, loss of opportunity, loss of data, or indirect or consequential loss, even if we have been advised such loss might occur.
If a court finds that we are liable to you for any reason, our total combined liability to you (where permitted by law) will be limited to NZD $100.
11. Your responsibility / indemnity
You agree to take responsibility for your own use of the Site.
If you provide information or otherwise use the Site in a way that causes us loss (for example, due to a legal claim by someone else), you agree to reimburse us for reasonable costs, expenses or damages we incur as a result, to the extent allowed by New Zealand law.
12. Changes to the Site and these Terms
We may update the Site, change features, or remove content at any time.
We may also update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. Your continued use of the Site after any changes means you accept the updated Terms.
If we make major changes, we may also highlight them on the Site.
13. Governing law
These Terms, and any disputes arising out of or in connection with them or the Site, are governed by the laws of New Zealand.
You agree to the non‑exclusive jurisdiction of the New Zealand courts.
